TAX HOLIDAYS

The amount of investment eligible is between 500 Billion up to 1 Trillion Rupiahs. The investor can apply through Investment Coordination Board (BKPM) to be processed by the relevant ministry. It is hoped that the incentives will boost the investment related to the sectors which could create plenty of jobs and help the economy through crisis.

The government of Indonesia has issued the new regulation regarding the tax holiday for business. The regulation is issued under the MOF Decree (PMK) no 159/PMK.0.10/2015. The new regulation will simplify the application process to obtain tax holiday. The coverage of business applicable for the incentive and the package are, in general, almost the same.

The approval of the tax holiday is in the hand of Minister of Finance. This is a shortage in the chain of approval compare to the previous regulation. Previously, the approval should be made in consultation with the President. The verification made by Coordinating Minister of Economy has also been removed.

The reduction of Income Tax is given up to 100 percent of the Corporate Income Tax Liability or at the minimum of 10 percent. The duration of tax holiday is from 5 years to 15 years. In some cases, the holidays can be extended up to 20 years. This is really encouraging for the investment climate than the previous incentive. The old regulation gives only 5 – 10 years holidays.

There are also additional sectors that are added to be eligible for the incentives ie. Basic Metal, Oil Refinery, Chemical derived from Oil and Gas, Industrial Machinery, Agricultural Industry, Fisheries, Forestry, Telecommunication, Information and Communication, Sea Transport, Manufacturing within the Special Economic Zone and Infrastructure.
